The main Polish legal act concerning personal data protection will be updated soon. The project and the description of changes are available on the Polish President’s website. As can be read in the aforementioned documents, the most important changes relate to fines and pecuniary penalties. There are also some minor changes important to notice, for example concerning individual’s agree to process it’s data (it can be revoked, now). According to the project, the Inspector General will have more possibilities to make the data controllers obey the Act of 29 August 1997 on the Protection of Personal Data. It will be possible to fine anyone breaking the rules of data processing from EUR 1000 to EUR 100 000.
If the project is voted through in the Sejm and Senat, the data controllers and their employees may be fined 300% of their monthly salaries. There is one new penal provision related to the files registration in Inspector General for the Protection of Personal Data, pursuant to which it is required to notice any changes of information given to Inspector General during file registration.
